General Terms and Conditions of flustix GmbH<\/h1>\n

\u2013 Certification programmes, testing, audits and use of certification marks \u2013<\/p>\n

1. Scope<\/h3>\n

1.1
These General Terms and Conditions apply to all contracts between flustix GmbH, Kronprinzendamm 20, 10711 Berlin, Germany (\u201cflustix\u201d) and the client regarding product testing, laboratory analyses, audits, conformity assessments, certifications and the use of flustix certification marks.<\/p>\n

1.2
The client acts exclusively as an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB). Services to consumers within the meaning of Section 13 BGB are excluded.<\/p>\n

1.3
Any deviating or conflicting terms of the client shall apply only if expressly accepted by flustix in text form.<\/p>\n

2. The flustix certification system<\/h3>\n

2.1
flustix operates an independent certification system for the assessment of products, packaging, product contents, raw materials and semi-finished goods based on programme-specific criteria.<\/p>\n

2.2
flustix is the system owner of the certification programmes and the associated certification marks (flustix seals).<\/p>\n

2.3
All testing, audits and certifications are carried out exclusively by independent certification bodies, testing bodies and laboratories recognised by flustix. flustix itself is not a certification body.<\/p>\n

2.4
There is no entitlement to the appointment of a specific certification body.<\/p>\n

 <\/p>\n

3. The flustix certification mark portfolio<\/h3>\n

flustix operates several certification marks, each relating to a clearly defined object of assessment. The applicable certification programme in its valid version shall apply.<\/p>\n

3.1 flustix LESS PLASTICS TOTAL PRODUCT<\/strong><\/p>\n

This certification mark relates to the product and its packaging.
Product and packaging are assessed independently of each other and must each fulfil the requirements of the respective certification programme.<\/p>\n

3.2 flustix LESS PLASTICS PRODUCT<\/strong><\/p>\n

This certification mark relates exclusively to the product itself.
The packaging is not part of the assessment.<\/p>\n

3.3 flustix LESS PLASTICS PACKAGING<\/strong><\/p>\n

This certification mark relates exclusively to the packaging.
The product itself is not part of the assessment.<\/p>\n

3.4 flustix PRODUCT CONTENT MICROPLASTIC-FREE<\/strong><\/p>\n

This certification mark relates to product contents assessed as microplastic-free in accordance with the applicable programme-specific criteria.
Verification is based on laboratory testing by independent laboratories.<\/p>\n

3.5 flustix RECYCLED<\/strong><\/p>\n

This certification mark relates to the use of recycled materials in products, raw materials or semi-finished goods.
The certified recycled content refers exclusively to the tested object.<\/p>\n

3.6 flustix RECYCLABLE<\/strong><\/p>\n

This certification mark relates to the recyclability of packaging or semi-finished goods. Only the material or packaging structure is assessed.
The product itself is not part of the assessment.<\/p>\n

4. Preliminary assessment and application<\/h3>\n

4.1
The preliminary assessment serves to determine the suitability of the assessment object and to define the scope of testing and audits.<\/p>\n

4.2
The client shall provide all information, documentation and reference samples required for the preliminary assessment.<\/p>\n

4.3
Based on the preliminary assessment, the responsible certification body issues an offer for the testing and certification.<\/p>\n

5. Testing, audit and certification<\/h3>\n

5.1
The contract for testing, auditing and\/or certification is concluded exclusively between the client and the respective certification body.<\/p>\n

5.2
The assessment relates solely to the object defined in the offer.<\/p>\n

5.3
The client undertakes to provide complete and accurate information relevant to the assessment.<\/p>\n

5.4
Any changes affecting the certification shall be communicated to flustix without undue delay.<\/p>\n

6. Ongoing conformity checks<\/h3>\n

6.1
Certified objects are subject to regular conformity checks in accordance with the applicable certification programme.<\/p>\n

6.2
Scope and frequency depend on the respective certification mark.<\/p>\n

 <\/p>\n

7. Use of certification marks<\/h3>\n

7.1
Use of a flustix certification mark requires a valid certificate and the conclusion of a separate licence agreement with flustix.<\/p>\n

7.2
Use is limited to the certified object in its assessed configuration and is linked to an individual licence number.<\/p>\n

 <\/p>\n

8. Liability<\/h3>\n

8.1
flustix shall be liable without limitation in cases of intent or gross negligence.<\/p>\n

8.2
In cases of simple negligence, flustix shall be liable only for breach of essential contractual obligations and limited to foreseeable damages.<\/p>\n

8.3
No liability shall arise for incorrect assessment results caused by incomplete or incorrect information provided by the client.<\/p>\n

 <\/p>\n

9. Confidentiality and publication<\/h3>\n

9.1
flustix shall treat all information provided by the client as confidential.<\/p>\n

9.2
Certified objects may be published in the public flustix database together with the licence number.<\/p>\n

 <\/p>\n

10. Final provisions<\/h3>\n

10.1
German law shall apply exclusively.<\/p>\n

10.2
Place of jurisdiction is Berlin, Germany.<\/p>\n

10.3
Amendments and supplements require text form.<\/p>\n

10.4
Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.[\/vc_column_text]
